What Is the Form W-9?

The Form W-9 is an IRS tax form used in the United States.

This form is an official document used by third parties to request someone’s tax details. It’s also known as a Request for Taxpayer Identification Number and Certification.

Every business and company in the US has to provide a W-9 Form to any self-employed workers they hire.

The worker must then fill it out and send it back to the employer. It’s not necessary to send the completed form to the IRS—the employer uses the information provided on the W-9 form to submit another document called the Form 1099.

What’s the purpose of Form W-9?

The purpose of the Form W-9 is to confirm that the employee is responsible for their own income tax as well as their Social Security and Medicare payments.

Another function of Form W-9 is to avoid backup withholding. When you complete a W-9 you can certify that you’re not subject to backup withholding, which stops the employer from withholding taxes to be sent to the government and allows you to be paid in full.

Who Needs a W-9 Form?

If you’re a freelance contractor who has been hired by a company or business, you’ll need to complete a W-9 Form.

This includes:

  • Vendors: sellers and suppliers
  • LLC contractors: 1 or more workers
  • Freelancers: you work on your own terms
  • Independent contractors: 1 person with a fixed contract
  • Invited consultants: demonstrated legal economic relationship to a project

You do not need to complete a W-9 Form if your annual income is less than $600.

In addition to income paid to you, you’ll also need a Form W-9 for the following:

  • Debt cancellation
  • Real estate transactions
  • Mortgage interest you’ve paid
  • Contributions you made to an IRA
  • Acquisition or abandonment of secured property

You’ll need to provide the following information to complete the Form W-9:

How often do I need to complete a W-9 Form?
Usually W-9 Forms are updated once a year. However, if your contact information or Tax ID Number changes, you’ll need to complete a new one.
Is the W-9 Form submitted to the IRS?
No, the Form W-9 is not submitted to the IRS. It’s kept by the employer to use a reference for completing another form—the Form 1099.
What happens if I do not provide a Form W-9?
If you’re required to submit a W-9 Form and you fail to file one, you could be subject to backup withholding. This would allow your employer to withhold 28% of the money you’ve earned with them and forward it to the IRS.
Is a W-9 Form only used by U.S. companies?
The Form W-9 is only used by U.S.-based employers. Companies that are not based in the U.S. should follow the tax laws in the country they’re located in.
Can I put a non-U.S. address on my Form W-9?
If you’re a U.S. citizen living outside the U.S. you can enter an international address on the W-9 Form.
